Nichole Creative LLC Monthly Giveaway

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.

1. Definitions

For purposes of these Official Rules:

  • “Sponsor”: Nichole Creative LLC, including its subsidiaries, affiliates, advertising or promotion agencies, and their respective officers, directors, employees, and agents.
  • “Giveaway”: The Nichole Creative LLC Monthly Giveaway described herein.
  • “Entry” or “Entries”: A submission by an eligible participant for a chance to win the Giveaway.
  • “Winner”: The individual selected in a random drawing from among all eligible entries to receive the Prize.
  • “Prize”: The item(s) or cash alternative described in Section 6.
  • “Official Rules”: These rules governing the Giveaway.
  • “Bonus Entry”: An additional entry earned by completing specific promotional actions as detailed on the Giveaway page.
  • “Invalid Entry”: An entry that fails to comply with these Official Rules (e.g., duplicate, fraudulent, or non-compliant entries).

2. Sponsor

The Giveaway is sponsored by Nichole Creative LLC, located at 548 Market Street PMB 25929 San Francisco, California 94104. Participation in the Giveaway constitutes your full and unconditional agreement to these Official Rules and the decisions of the Sponsor, which are final and binding in all respects.

3. Eligibility & Disqualification

Eligibility Requirements

The Giveaway is open only to legal residents of the 48 contiguous United States and the District of Columbia who are at least the age of majority in their state of residence at the time of entry. Employees, officers, directors, agents, representatives, and immediate family members (spouse, parents, siblings, and children) of Nichole Creative LLC and its affiliated entities, including their advertising and promotion agencies, are not eligible to participate.

Exclusions & Disqualification

  • The Giveaway is void where prohibited by law.
  • Multiple free entries from the same individual will result in disqualification.
  • Any attempt to submit fraudulent, duplicate, or automated entries, or any attempt to interfere with the entry process, will be disqualified at the sole discretion of the Sponsor.
  • Participation in the Giveaway constitutes acceptance of these rules and the Sponsor’s decision as final with regard to eligibility and disqualification.

4. Giveaway Period

Entry Period

The Giveaway begins on the first day of each month at midnight Pacific Time and ends on the last minute of that month Pacific Time (“Entry Period”). For example: The January 2026 giveaway will start on January 1st 2026 at 12:00AM Pacific Time and end on January 31st 2026 at 11:59PM Pacific Time. All entries must be received within this period to be eligible.

5. How to Enter

Method of Entry

To enter the Giveaway, participants must subscribe to the NicholeCiotti.com newsletter by submitting the required information on the official Giveaway website: https://nicholeciotti.com. The giveaway for the current month can be found on the homepage.

No Purchase Necessary

No purchase or payment of any kind is necessary to enter or win.

Entry Limit

One (1) free entry per person, per email address is permitted. Failure to adhere to these guidelines may result in disqualification.

Bonus Entry Opportunities

Any Bonus Entry opportunities, if provided, will be clearly communicated on the Giveaway page. Failure to comply with additional entry instructions may result in those Bonus Entry opportunities being void.

6. Prize Description and Tax Liability

Prize Package

Refer to the current month's giveaway page on NicholeCiotti.com for the active prize package.

Alternative Option

The Winner may opt to receive a cash equivalent in lieu of the prize package.

Prize Substitution

In the event any prize is unavailable, the Sponsor reserves the right to substitute the prize with another item or cash alternative of equal or greater value.

Tax Liability

The Winner is solely responsible for any and all federal, state, or local taxes, fees, or other expenses associated with the receipt or use of the Prize.

7. Winner Selection and Notification

Random Drawing

The Winner will be selected at random from all eligible entries received during the Entry Period. The drawing will be conducted on or about the first day of the month following the Entry Period.

Notification Process

The selected Winner will be notified via the email address provided at the time of entry within 48–72 hours following the drawing.

The Sponsor is not responsible for any notification failures due to incorrect or outdated contact information.

Winner Verification

Prior to the awarding of any prize, the selected Winner may be required to provide government-issued photo identification or other evidence to verify their identity and eligibility. Failure to provide such verification within the specified timeframe may result in disqualification and the selection of an alternate Winner.

Response Deadline

The Winner must respond to the notification within 72 hours. Failure to respond within this period, or an invalid response, may result in the selection of an alternate Winner from the remaining eligible entries.

Odds of Winning

The odds of winning depend on the number of eligible entries received.

8. Publicity and Media Release

By entering the Giveaway, participants agree that if selected as the Winner, their name, likeness, and entry may be used for advertising, promotional, and publicity purposes in any media now known or hereafter developed, without additional compensation, unless prohibited by law.

9. Indemnification and Release of Liability

Indemnification

By participating in the Giveaway, entrants agree to indemnify, defend, and hold harmless the Sponsor, its affiliates, subsidiaries, and their respective officers, directors, employees, and agents from and against any and all claims, actions, damages, or losses arising from or in connection with participation in the Giveaway or acceptance/use of any Prize.

Release of Liability

By entering the Giveaway, you release and hold harmless the Sponsor from any claims, losses, or damages of any kind arising from or in connection with this Giveaway, including any technical failures or errors that may occur.

10. Limitation of Liability

The Sponsor is not responsible for and shall not be liable for any incorrect or inaccurate information, technical malfunctions, unauthorized human intervention, or any other errors which may occur in the administration of the Giveaway or the processing of entries, including but not limited to damage, loss, injury, or any injury or damage to persons or property resulting from or in connection with the Giveaway or the acceptance, possession, or use of any Prize.

11. Privacy and Data Use

Any personal information submitted in connection with the Giveaway will be used solely for the purposes of administering the Giveaway and for future promotional communications from the Sponsor. For more detailed information on how your data is handled, please refer to the Sponsor’s Privacy Policy. By entering the Giveaway, you consent to the collection, use, and storage of your information as described therein.

12. Dispute Resolution and Governing Law

Dispute Resolution

Any disputes, claims, or controversies arising out of or relating to the Giveaway or these Official Rules shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal courts located in San Francisco County, California. The Sponsor and entrant agree that any claims will be resolved on an individual basis.

Governing Law

These Official Rules and the Giveaway shall be governed by and construed in accordance with the laws of the State of California and the United States, without regard to conflict of law principles.

Waiver of Jury Trial

To the fullest extent permitted by law, each entrant waives any right to a trial by jury or to participate in a class action.

13. Miscellaneous Provisions

Void Where Prohibited

The Giveaway is void where prohibited by law.

Modification and Termination

The Sponsor reserves the right to cancel, suspend, or modify the Giveaway or any part thereof if fraud, technical failures, or any other factor beyond the Sponsor’s reasonable control impairs the integrity or proper functioning of the Giveaway.

Force Majeure

The Sponsor shall not be liable for any delay or failure in performance due to circumstances beyond its reasonable control, including, but not limited to, acts of God, natural disasters, war, or other unforeseen events.

Severability

If any provision of these Official Rules is found to be unenforceable or invalid under any applicable law, such invalidity shall not render these Official Rules unenforceable or invalid as a whole. Instead, such provisions shall be modified to reflect the original intent as closely as possible.

Sponsor’s Rights

The Sponsor reserves the right to disqualify any participant or entry that violates these Official Rules or exhibits fraudulent behavior.

Third-Party Disassociation

This Giveaway is not sponsored, endorsed, administered by, or associated with any social media platform or third-party brand on which it may be promoted, including but not limited to Instagram, TikTok, Facebook, YouTube, and Pinterest.
